Terms governing your use of the UTM Capital investor financing portal.

1. Acceptance of these terms

UTM Capital (the "Portal," "we," "us," or "our") is a co-branded investor financing referral portal operated by United Trust Mortgage, an NMLS-licensed mortgage broker (NMLS #2591548), in partnership with Raider Lending Solutions. By accessing or using this Portal you agree to these Terms & Conditions. If you do not agree, do not use the Portal.

2. Informational use only; not a commitment to lend

The content on this Portal is provided for general informational purposes only. Nothing on this Portal constitutes a commitment to lend, a pre-approval, an offer to extend credit, or a lock of any rate or program. All loans are subject to credit, underwriting, appraisal, and program guidelines, and not all applicants will qualify. Loan terms, rates, and availability are subject to change without notice.

3. No guarantee of approval

Submitting an inquiry or application through this Portal does not guarantee approval or that any specific loan product, rate, term, or program will be available to you. Each application is evaluated based on complete information and applicable underwriting criteria.

4. Referral & co-branded portal usage

This Portal is operated by United Trust Mortgage in partnership with Raider Lending Solutions. Raider Lending Solutions is a referral partner and is not the mortgage lender on this Portal. The licensed mortgage entity originating any investor loan applied for through this Portal (including DSCR purchases, refinances, and cash-outs) is United Trust Mortgage, an NMLS-licensed mortgage broker (NMLS #2591548). By using this Portal you acknowledge that your inquiry or application may be shared between the co-brand partners and their service providers as necessary to process your request, as described in our Privacy Policy.

5. Accuracy of information

You agree that all information you provide through the Portal is true, accurate, current, and complete. Knowingly providing false or misleading information in connection with a mortgage application may be a violation of federal and state law.

6. Third-party applications and links

The application flows accessed through this Portal may be hosted by third-party platforms (including third-party loan origination systems). Your use of those platforms is governed by their own terms and privacy policies. The Portal may also contain links to third-party websites for informational purposes; we are not responsible for the content, policies, or practices of those sites.

7. Intellectual property

All content on this Portal, including text, graphics, logos, and layout, is owned by UTM Financial, Raider Lending Solutions, or their respective licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Portal content without prior written permission, except for personal, non-commercial review of the Portal.

8. Licensing & disclosures

United Trust Mortgage is an NMLS-licensed mortgage broker (NMLS #2591548). You can verify the license of United Trust Mortgage through the NMLS Consumer Access website.

Applicants are subject to credit and underwriting approval. Not all applicants will be approved for financing. Receipt of application does not represent an approval for financing or interest rate guarantee. Refinancing your mortgage may increase costs over the term of your loan. Restrictions may apply. Savings, if any, vary based on the consumer's credit profile, interest rate availability, and other factors. United Trust Mortgage is not a chartered bank or trust company, or depository institution. It is not authorized to accept deposits or trust accounts and is not licensed or regulated by any state or federal banking authority.

9. Equal Housing Lender

United Trust Mortgage is an Equal Housing Lender and complies with the Equal Credit Opportunity Act (ECOA) and the Fair Housing Act. We do not discriminate on the basis of race, color, religion, national origin, sex, marital status, age, disability, familial status, or any other characteristic protected by law.

10. Disclaimer of warranties

The Portal and all content are provided "as is" and "as available," without warranty of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or availability. We do not warrant that the Portal will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of liability

To the maximum extent permitted by law, United Trust Mortgage, Raider Lending Solutions, and their respective affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or related to your use of or inability to use this Portal, even if advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless United Trust Mortgage, Raider Lending Solutions, and their respective affiliates and service providers from and against any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Portal or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or your use of the Portal will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Your continued use of the Portal after changes take effect constitutes acceptance of the updated Terms.
